Artist Resale Royalty Agreement (A Contractual Right): By purchasing this original artwork, the buyer expressly agrees to a contractual Artist Resale Royalty (ARR) of 5% of the gross resale price for all subsequent resales of this work. This royalty is due to Hubert Neal Jr. (the Artist) regardless of where or by whom the artwork is resold, and applies to both public and private sales where the gross resale price is equal to or greater than the original purchase price.
This agreement is a fundamental condition of the sale, designed to ensure the Artist participates in the long-term appreciation and economic life of their creation. The original buyer agrees to:
Inform any subsequent buyer of this contractual obligation.
Notify the Artist (or their designated representative/estate) within 30 days of any resale.
Remit the 5% royalty to the Artist (or their designated representative/estate) within 30 days of receiving payment for the resale.
This contractual ARR supersedes and operates independently of any statutory resale royalty laws (such as the California Resale Royalty Act, which has limitations). It is an enduring covenant tied to the artwork itself, reinforcing the Artist's continued stake in their creation.
